TrackSource provides a marketing attribution platform that helps businesses track and analyze their marketing performance, including event tracking, conversion attribution, and analytics dashboards ("Service"). We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

To use certain features of the Service, you must register for an account. When you register, you agree to:

Maintain the security of your password and account
Accept responsibility for all activities under your account

4. Subscription and Billing

4.1 Subscription Plans

TrackSource offers various subscription plans with different features and usage limits. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page.

4.2 Payment Processing

All payments are processed by Paddle, our Merchant of Record. Paddle handles all billing inquiries, payment processing, and acts as the seller of record for all transactions. By making a purchase, you also agree to Paddle's Terms of Service.

4.3 Billing Cycle

Subscriptions are billed in advance on a monthly or annual basis depending on your chosen plan. Your subscription will automatically renew unless cancelled before the renewal date.

4.4 Price Changes

We reserve the right to modify our pricing. Any price changes will be communicated in advance and will apply to the next billing cycle.

5. Free Trial

We may offer a free trial period for paid plans. At the end of the trial, your account will be automatically charged unless you cancel before the trial ends. We reserve the right to limit free trials to one per customer.

6. Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation:

You will retain access until the end of your current billing period
No refunds will be provided for partial billing periods
Your data will be retained for 30 days, then permanently deleted

7. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe on intellectual property rights of others
Transmit malicious code or interfere with the Service
Attempt to gain unauthorized access to systems or data

Resell or redistribute the Service without authorization
Send spam or unsolicited communications

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring that your use of the Service complies with all applicable data protection laws and that you have obtained necessary consents from your end users for data collection and processing.

We strive to maintain high availability of the Service. Support is provided according to your subscription plan level. Enterprise customers may be eligible for custom SLAs.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACKSOURCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless TrackSource and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TrackSource is incorporated, without regard to conflict of law provisions.
